⏱ 15 min read · the option that keeps people in their homes

Behind on your mortgage does not always mean you have to sell your home!

I worked with a homeowner recently who went through a temporary hardship and fell behind on her payments. We worked together with her bank, and she was approved for a loan modification. She is still in her house.

I say I save more homes than I sell, and stories like hers are exactly why.

Most people never apply. That is the real reason most people do not get one!

Not income. Not credit. Not the hardship. The application that never got finished, or never got started at all.

A loan modification permanently changes the terms of your mortgage so the payment becomes something you can actually make. Not a pause. Not a loan. A permanent change to the agreement itself.

And it is the single most common way a Florida homeowner in trouble ends up staying in their home.

I'm Kady. I help Florida homeowners through foreclosure, hardship, inherited property, illness, divorce, and all the other things that show up uninvited. I am a Realtor with Momentum Realty and an investor, and I am going to tell you something a lot of investors would not.

If a modification works for you, take the modification. It costs me a sale and it keeps you in your house, and that is not a difficult trade for me. It is about finding the best solution for the homeowner, and sometimes that solution has nothing at all to do with me.

The short version

What you qualify for depends almost entirely on who owns or insures your loan, not on which bank you send the cheque to. Conventional loans backed by Fannie Mae or Freddie Mac use the Flex Modification, which targets a 20 percent reduction in your principal and interest payment. FHA has a whole menu including a Payment Supplement that lowers your payment without touching your interest rate. VA loans went back to standard servicer tools after VASP closed in 2025. Once you submit a complete application more than 37 days before a foreclosure sale, your servicer has to review you and cannot advance the foreclosure while it is pending. Applications fail because of missing paperwork far more often than because of income. Free help with the paperwork exists, and it genuinely works.

If you only remember six things

  • Find out who owns your loan before anything else. It decides which programs even exist for you.
  • Complete beats fast. A complete application is what switches on your legal protections. A partial one does nothing.
  • 37 days before a sale is the cutoff that triggers the strongest protection. Earlier is better by a mile.
  • Never miss a trial payment. Not one, not by a day. That is where approvals fall apart.
  • You can appeal a denial in many cases, and you should.
  • The help is free. Nobody legitimate charges you upfront to apply for this.
01

What a Modification Actually Is

People mix these up constantly, so let us be precise.

A modification permanently rewrites your loan. The servicer can roll your missed payments into the balance, lower your interest rate, stretch the term out longer, or set aside a chunk of principal so you are not paying interest on it. Usually some combination.

The result is one new payment that you can actually afford, going forward, forever.

That is different from everything else on the menu:

How a modification differs from the other options your servicer may mention.
OptionWhat it doesPermanent?
ReinstatementYou pay everything past due in one lump and the loan returns to normalNo change to terms
Repayment planThe arrears are spread across higher payments for several monthsTemporary, and your payment goes up
ForbearancePayments pause or reduce during a hardshipTemporary, and the money still comes back
Payment deferralMissed payments move to the end of the loan, due when you sell or pay offPermanent for the arrears, but your payment stays the same
Partial claimArrears move into a separate interest free junior lienPermanent for the arrears, FHA and some others only
ModificationThe loan itself is rewritten into a new, lower paymentYes, permanently

Which one fits you depends on what kind of hardship you had.

If something knocked you down temporarily and your income is back where it was, you probably do not need a modification. A repayment plan or a deferral may put you right without changing your loan at all, and that is a better outcome.

A modification is for when the income came back but came back lower, or the costs went up and are not going down. A permanent problem needs a permanent fix.

And that is worth saying plainly, because in Florida right now a great many of these are not job loss cases at all. They are insurance premiums and property taxes landing in the escrow portion of the payment and simply never going back down.

02

It All Depends on Who Owns Your Loan

This is the part almost nobody explains, and it is the single most useful thing on this page.

The company you send your payment to is usually just the servicer. They collect, they handle the paperwork, they answer the phone. But they are mostly following somebody else's rulebook, and whose rulebook it is decides what you can be offered.

So before anything else, find out who owns or insures your loan. You can ask your servicer directly, and for conventional loans Fannie Mae and Freddie Mac both run free online lookup tools. Five minutes.

Conventional · most common

Fannie Mae or Freddie Mac

The Flex Modification. It targets a 20 percent reduction in your principal and interest payment, working through the steps in order: capitalise the arrears, lower the rate, extend the term out as far as 480 months, then forbear principal if needed. Payment deferral and repayment plans sit alongside it for shorter hardships.

Enhanced December 2024

FHA · the richest menu

FHA insured loans

Repayment plans, forbearance, partial claims, modifications, and the Payment Supplement, which reduces your payment by roughly a quarter for three years without changing your interest rate. The COVID era options and FHA-HAMP have ended and been replaced by a permanent framework.

FHA line: 800-225-5342

VA · changed recently

VA guaranteed loans

The VASP program closed to new applicants on 1 May 2025, and the Home Retention Waterfall was rescinded in May 2026. Veterans are back to the standard servicer tools: repayment plans, special forbearance, modifications and partial claim structures. Early contact matters more than ever here.

Ask for a loss mitigation review

Portfolio · no rulebook

Loans the lender kept

Some lenders, especially credit unions and smaller banks, hold their own loans. There is no investor rulebook, which cuts both ways. They have complete freedom to help you, and complete freedom not to. These are often the most negotiable conversations in the whole business.

Worth asking directly
20% is the payment reduction the Flex Modification aims for on conventional loans backed by Fannie Mae or Freddie Mac. Not every modification reaches it, and the steps stop once the target is met. But that is the goal the servicer is working toward on your file. enhanced policy effective December 2024

USDA loans have their own set of options, and if you have a second mortgage or a home equity line, that lender has to be dealt with separately. A modification on the first does not touch the second.

If you have a low pandemic era rate, say so out loud

A lot of Florida homeowners refinanced at 3 percent or under between 2020 and 2022. That rate is genuinely valuable, and some options protect it while others do not.

FHA's Payment Supplement specifically does not require an interest rate change, which means borrowers with a good rate can get real payment relief and keep it. A payment deferral leaves your rate alone too. A full modification, on the other hand, may raise your rate to a current market figure as part of the restructuring.

So ask the question directly: what happens to my interest rate under each option you are offering me? It is a perfectly reasonable thing to ask and it can be worth tens of thousands over the life of the loan.

03

The Rules That Are On Your Side

Federal mortgage servicing rules give you real protection here, and I think this should be taught in school honestly. Almost nobody knows any of it.

They have to reach out to you. If the home is your principal residence, your servicer must try to contact you by phone about your options by around day 36 of delinquency, and send written information about them by day 45. They also have to assign you people who can actually tell you where your file stands.

They generally cannot file anything until you are more than 120 days behind. That is roughly four missed payments, and in Florida all the court time comes on top of it.

And here is the big one.

37 days If your complete application arrives more than 37 days before a scheduled foreclosure sale, your servicer must evaluate you for every option available on your loan. They then owe you a written decision, normally within 30 days, and they cannot move for judgment or conduct a sale while that review is open. this is what a complete file buys you

Running a foreclosure and a modification review at the same time is called dual tracking, and it is not allowed. That protection is real and it has teeth.

But read that stat card again and notice the word complete.

Almost all of this switches on only when a complete application is in. Not a phone call. Not good intentions. Not most of the documents with two still to come. A complete application sitting in review is working for you around the clock. An incomplete one is doing very little.

Get the package in, get it complete, and keep a copy of everything you send with the date you sent it.

And in Florida specifically

You can defend a foreclosure lawsuit and pursue a modification at the same time. These are not competing choices and doing one does not sabotage the other.

If you have been served with court papers, you have 20 days to file a written response, and that deadline runs whatever is happening with your application. Servicers negotiate with defended cases every single day. Please do not let a pending modification lull you into missing a court deadline, because I have watched that happen and it is heartbreaking.

04

Why Applications Really Get Denied

Here is what I wish every homeowner understood before they start.

Far more applications fail over paperwork than over money. Missing pay stubs. An unsigned form. A bank statement that cut off the last page. A document that went stale because the review took eleven weeks and now they need fresh ones.

None of those are a judgment about you. They are an administrative outcome, and they are preventable.

The myth

My credit is wrecked from the missed payments, so there is no point applying.

The truth

A modification is not a new loan and there is no credit score minimum to clear. The whole programme exists for people who are already behind. Your credit is not what they are looking at.

The myth

I am on Social Security or a pension, so I do not have real income and will not qualify.

The truth

Social Security, pension, disability, retirement income and rental income all count. What they need to see is stable, documented income sufficient for the new lower payment. Fixed income is income!

The myth

I called and explained everything, so my application is in and I just have to wait now.

The truth

A phone call is not an application. Until the documents are received and the file is marked complete, nothing is protecting you and the clock has not stopped. Ask directly: is my file complete, and what are you still missing?

The other genuine reasons for a denial, so you know the real ones:

  • Not enough income to support even the modified payment. If the lowest payment they can build is still beyond you, there is nothing to approve. This is the honest one.
  • Too much income. It happens. If the file shows you can afford the current payment, you will be told to make it.
  • No documented hardship. There needs to be a reason, written down, with evidence behind it.
  • It is not your primary residence. Many programmes are limited to owner occupied homes.
  • You have had one recently. FHA, for example, generally allows one permanent home retention option within any 24 month period unless a presidentially declared disaster is involved.
  • The investor said no. Occasionally the rulebook simply does not permit it on that loan.

Notice how few of those are about you as a person. Most of this is arithmetic and paperwork.

05

How to Apply, Step by Step

This is the whole process. It is more tedious than it is difficult, and the tedium is exactly why free help is worth taking.

1
Day one

Find out who owns your loan

Ask your servicer, or use the free Fannie Mae and Freddie Mac lookup tools for conventional loans. Your mortgage statement or closing paperwork will tell you if it is FHA, VA or USDA. This single answer decides which programmes exist for you, so start here rather than guessing.

2
Same day

Call and say the words

"I am experiencing a hardship and I would like to apply for loss mitigation." Then ask what documents they need, ask for your single point of contact, and write down the date, the name and a reference number. Fifteen minutes. This is the call people put off for six months.

3
This week

Get a free HUD approved counselor

Call 800-569-4287 or the HOPE Hotline at 888-995-HOPE. Foreclosure counseling is free by design and the counselor works for you, not your lender. They know which programmes your loan type offers and they will build the package so it does not bounce back incomplete. This is the highest value call on the whole list.

4
Gather

Assemble the documents

Usually a hardship letter, recent pay stubs or proof of other income, the last two years of tax returns, recent bank statements, a monthly budget, and a signed request for mortgage assistance form. Self employed? Expect profit and loss statements too. Scan everything, keep copies, and note the date you sent each item.

5
Critical

Confirm the file is complete, in writing

Do not assume. Call and ask: is my application complete, and if not what exactly is outstanding? Ask them to confirm completeness in writing. That word is what switches on your protections, and it is the difference between a file that is working for you and one that is just sitting there.

6
Keep calling

Follow up weekly, and log every call

Date, time, name, what they said, reference number. Files get reassigned constantly and documents genuinely do go missing. Be the person with the record. If they ask for the same document a second time, send it again without arguing and note that you did.

7
Decision

Read the written decision carefully

You are owed one, normally within 30 days of a complete file. If it is an approval, check the new payment, the new rate, the new term and the trial period dates before you sign anything. If it is a denial, it should tell you why and whether you can appeal.

One more thing on documents. Hardship letters make people freeze, and they should not. It does not need to be eloquent. It needs to be true, specific and short.

What happened, when it happened, what it did to your income or your costs, what has changed since, and what you are asking for. A paragraph or two is plenty. Nobody is grading your writing.

06

The Trial Period, and What Comes After

Most approvals do not go straight to permanent. They start with a trial period plan, usually three months, sometimes longer.

You make the proposed new payment three times, on time, and then the modification becomes permanent.

I want to be emphatic about this part, because it is where I see approvals fall apart after all the hard work is already done.

A trial modification is not a modification yet

Every single trial payment must arrive on time and in full. Not most of them. Not one a few days late because of a pay cycle. All of them, on time.

If you miss one, the trial can fail, the offer can be withdrawn, and you can find yourself back where you started having lost months. Pay early rather than on the due date. Set a reminder. If a payment is genuinely going to be late, call them before it is late rather than after.

Once it goes permanent, you sign the modification agreement and the new terms replace the old ones. Read it properly before you sign, and if anything differs from what you were told on the phone, ask about it in writing before signing rather than after.

What a modification does to your credit

A fair question and the honest answer is: less than what came before it.

The real damage to your credit has usually already happened in the string of missed payments leading up to the application. The modification itself may be reported, and it is not nothing, but it is dramatically better than a completed foreclosure, which stays on your reports for around seven years.

The other thing worth noting is that once the modified loan is current and you keep it current, you start rebuilding from that point. A foreclosure gives you nothing to rebuild from.

The honest limitations

Three things people are often not told until later.

Your balance may go up. Capitalising the arrears means the missed payments get added to what you owe. Lower payment, bigger balance. For most people that is a very acceptable trade, but you should know it is happening.

You may pay more over the life of the loan. Stretching a term out to 40 years lowers the monthly figure and raises the total. Again, usually worth it. Just go in with your eyes open.

It does not fix the underlying costs. If your problem is a Florida insurance premium that doubled, a modification resets the payment but the premium can rise again next year. Please deal with the cause as well as the symptom. Shop your insurance, ask about a wind mitigation inspection, and check whether you are getting every property tax exemption you are entitled to. That part is on you and it matters.

07

If You Are Denied

It is not the end of the road. Work through these in order.

Read the denial letter properly. It should state the reason. Sometimes it is an administrative reason you can fix in a week, like a missing document or stale paperwork. Those are not real denials at all, they are paperwork problems wearing a denial's clothes.

Appeal if you can. Where a complete application was submitted in good time, you often have a right to appeal a denial of a retention option, usually within a short window of the decision. The letter should tell you. Appeals are reviewed by different personnel than the original decision, and they do get overturned.

Ask what else you qualify for. A denial on a modification does not mean a denial on everything. A repayment plan, a payment deferral, a partial claim or a forbearance may still be available on your loan, and you should ask for each by name rather than waiting to be offered.

Reapply if your circumstances change. A new job, a second income in the household, a documented change in expenses. These are not one time shots in most cases.

Then look honestly at the other paths. If the numbers simply will not work even at the lowest possible payment, that is painful information but it is still information, and having it early is worth a great deal.

Selling before an auction protects whatever equity you have, keeps a foreclosure off your credit, and lets you choose your own moving date. Florida values moved a long way after 2020, and a lot of the homeowners I meet have real equity they have never had valued. A short sale may fit if you owe more than it is worth. Bankruptcy stops a sale immediately and Chapter 13 can cure arrears over three to five years, which is genuinely a lawyer's conversation.

All of those are better than letting an auction decide it for you.

Four things, if that is all you keep.

Find out who owns your loan. Say the words loss mitigation. Make the file complete and confirm it in writing. Never miss a trial payment.

Behind on your mortgage does not always mean you have to sell your home. Sometimes it means a few weeks of paperwork and a phone call you have been dreading.

I would rather help you keep it. Really.

Behind on your mortgage? Let's talk through what's going on.

Tell me what happened and I will help you work out who owns your loan, which options actually exist for you, and who to call first. If a modification is your answer I will say so and point you to the free help. If selling turns out to be the better move, you will get a fair, no obligation cash offer with no pressure and no timeline from your side.

Questions People Ask Me

Can I get a loan modification in Florida if I am already behind?

Yes, and being behind is usually the point rather than a barrier. These programmes exist for homeowners who are delinquent or about to be. What matters is that you have a documented hardship, enough stable income to support a lower payment, and a complete application. Being behind is not what disqualifies people. An unfinished application is.

What credit score do I need for a loan modification?

There is no credit score requirement. A modification is not a new loan, so there is no underwriting of your credit in the way there would be for a refinance. The missed payments that damaged your score are the very reason you are eligible to apply in the first place.

How much can a modification lower my payment?

On conventional loans backed by Fannie Mae or Freddie Mac, the Flex Modification targets a 20 percent reduction in principal and interest, though not every file reaches that. FHA's Payment Supplement reduces the payment by roughly a quarter for three years without changing your interest rate. The actual figure depends on your balance, your rate and how far the servicer can stretch the term.

How long does a loan modification take?

Expect roughly 30 to 90 days from a complete application to a decision, and longer if documents are missing or need refreshing. Once a complete application is received, the servicer generally owes a written decision within 30 days. A trial period of about three months usually follows before the modification becomes permanent.

Will a modification stop my Florida foreclosure?

A complete application submitted more than 37 days before a scheduled sale triggers strong protection. The servicer must evaluate you for available options and cannot move for judgment or conduct the sale while that review is pending. That is the dual tracking prohibition. It is also why timing matters so much, because applying a week before a sale date gives you far less.

Do I still have to respond to the court if I am applying for a modification?

Absolutely yes. In Florida you have 20 days from being served to file a written response with the court, and that deadline runs independently of anything happening with your application. Missing it lets the lender seek a default judgment. Defending the lawsuit and pursuing a modification are not competing choices, and lenders negotiate with defended cases every day.

How do I find out who owns my mortgage?

Ask your servicer directly, since they are required to tell you. For conventional loans, Fannie Mae and Freddie Mac both operate free online lookup tools. Your mortgage statement or closing documents will indicate whether the loan is FHA, VA or USDA. This answer determines which programmes are available to you, so it is the first thing to establish.

Will my interest rate go up with a modification?

It can. A full modification may adjust your rate to a current market figure as part of restructuring the loan, which matters a great deal if you hold a low pandemic era rate. Some options avoid this: FHA's Payment Supplement specifically does not require an interest rate change, and a payment deferral leaves the rate alone. Ask your servicer directly what happens to your rate under each option offered.

What documents do I need for a loan modification?

Typically a hardship letter, recent pay stubs or proof of other income, the last two years of tax returns, recent bank statements, a monthly budget and a signed request for mortgage assistance form. Self employed applicants usually need profit and loss statements as well. Keep copies of everything and note the date each item was sent.

Can I get a modification on Social Security or pension income?

Yes. Social Security, pension, disability, retirement and rental income all count. What the servicer needs is stable, documented income sufficient to support the modified payment. Fixed income is income, and a great many approved modifications belong to retired homeowners.

What happens if I miss a trial payment?

The trial can fail and the offer can be withdrawn, which may put you back where you started having lost several months. Every trial payment must be on time and in full, without exception. Pay early rather than on the due date, and if a payment is genuinely going to be late, call the servicer before it is late rather than afterwards.

Does a loan modification hurt your credit?

Less than what preceded it. Most of the damage usually came from the missed payments before the application. A modification may be reported and is not nothing, but it is far better than a completed foreclosure, which remains on credit reports for around seven years. Once the modified loan is current and stays current, rebuilding begins from there.

Can I apply for a modification more than once?

Often yes, particularly if your circumstances have changed. There are limits on some programmes: FHA, for example, generally permits one permanent home retention option within any 24 month period unless a presidentially declared major disaster applies. Ask your servicer what restrictions apply to your specific loan.

Can I be denied and then appeal?

In many cases yes. Where a complete application was submitted in good time, you generally have the right to appeal the denial of a retention option within a short window of the decision, and the appeal is reviewed by different personnel. Read the denial letter carefully, because it should state both the reason and your appeal rights.

Should I pay a company to handle my modification?

No, and be careful here. Charging upfront fees for loan modification services is not permitted, HUD approved housing counseling is free by design, and legal aid represents qualifying homeowners at no cost. If someone guarantees approval, asks for money before doing anything, or tells you to stop paying your lender and pay them instead, walk away.
