He had been paying that mortgage in Orange Park since 2013. Retired out of NAS Jax, bought with his entitlement, never missed a payment in eleven years.

Then the insurance renewal came in nine hundred dollars higher, the escrow recalculated, and by the time he rang anybody he was four payments down and there were papers from Green Cove Springs on his kitchen table.

He thought he was the only person in Clay County this had happened to. He was not close to being the only person on his street.

The law is the same across Florida. The courthouse, the clerk and the help are all local.

Clay County cases are filed in Green Cove Springs, in the Fourth Judicial Circuit. Knowing where your own case actually lives is the first thing that makes this manageable.

I’m Kady. I help Florida homeowners through foreclosure, hardship, inherited property, illness, divorce, and all the things that arrive without warning. I am a Realtor with Momentum Realty and I buy houses, and I work Clay County properly rather than treating it as the bit west of the river.

I have listed in The Ravines in Middleburg. I have sat at a kitchen table in Orange Park with a family sorting out a probate nobody had opened. I drive Blanding and 17 and the 220 corridor most weeks.

So this page is not a Jacksonville article with the city name swapped out, which is most of what you will find when you search this. It is where your case physically sits, what is actually driving defaults in this county right now, who to ring here, and what your options look like from Clay rather than from Duval.

The short version

Clay County sits in Florida’s Fourth Judicial Circuit, alongside Duval and Nassau, and foreclosure cases are filed at the Clay County Courthouse, 825 North Orange Avenue, Green Cove Springs. The Clay County Clerk of Courts runs a free online case search at clayclerk.com where you can look your own case up by name or case number and read the docket yourself. Florida is a judicial foreclosure state, so your lender has to sue, and once you are served you generally have 20 days to file a written response. Sales are conducted online through the clerk, advertised after final judgment. What is driving most Clay defaults right now is not job loss: it is insurance and escrow, plus property taxes, plus in several of the newer communities a CDD assessment riding on the November tax bill. Free help exists locally and the three numbers that matter are a HUD approved housing counselor, Jacksonville Area Legal Aid, and the Clay County Tax Collector.

If you only remember six things
  • Your case is in Green Cove Springs, not Jacksonville. Fourth Circuit, Clay County Courthouse.
  • Read your own docket. The clerk’s online search is free and it is the truth about where you stand.
  • 20 days from service to respond. That one deadline decides how much leverage you keep.
  • Most Clay defaults start with escrow, not income. Fix the cause, not just the arrears.
  • Check for a CDD line on your tax bill. In several Clay communities it is thousands a year.
  • A sale date is a deadline, not a verdict. Most scheduled auctions do not happen on the day.

01Where Everything Actually Happens

A surprising amount of the fear in this process comes from not knowing where anything is. So here is your county, concretely.

Clay County, the practical geography of a foreclosure case. Confirm current details with each office, since hours and procedures change.
What Where
Judicial circuit Florida’s Fourth Judicial Circuit, which covers Clay, Duval and Nassau
Courthouse Clay County Courthouse, 825 North Orange Avenue, Green Cove Springs, FL 32043
Clerk of Courts Clay County Clerk of Courts, clayclerk.com, with free online case search by party name, case number or attorney
Foreclosure sales Conducted online through the clerk, scheduled and advertised after final judgment. Bidders register and place deposits in advance
Legal notices Published locally, including in the county’s legal notice publications. Notices of sale are how the publication requirement in section 45.031 is satisfied
Property Appraiser Clay County Property Appraiser, for homestead exemption, assessed value and ownership of record
Tax Collector Clay County Tax Collector, for the tax bill, delinquent years, certificates and the installment plan

The single most useful thing on that list is the clerk’s free case search. Go and look your own case up today. You will see what has been filed, what has been ordered, whether a sale date has been set, and whether anything has been cancelled or continued.

People avoid this because they think the docket will tell them something terrible. Usually it tells them they have more time than they feared, and occasionally it tells them something urgent they did not know about. Either way, you want to be the person who knows.

02The Timeline, Clay County Edition

Florida is a judicial foreclosure state, which is genuinely good news for you. Your lender cannot simply post a notice and sell your house. It has to sue you in circuit court and win, and every step of that is visible and takes time.

1
before anything

Missed payments and the demand letter

Late fees, calls, then a written demand or breach letter giving you a period to cure. Nothing has been filed yet and this is the cheapest point in the entire process. Almost everybody waits past it.

2
it becomes public

Complaint and lis pendens

The lender files in the Fourth Circuit at Green Cove Springs and records a lis pendens against your property in the Clay County official records. From this point your case is searchable on clayclerk.com.

3
20 days

You are served

Once formally served with the summons and complaint you generally have 20 days to file a written response with the court. This is the most important deadline in the whole process. Miss it and you risk a default judgment, which strips most of your ability to raise defences or negotiate.

4
months

The case proceeds

Motions, discovery, possibly mediation. How long this takes depends enormously on whether you responded and whether you have counsel. An undefended case moves quickly. A defended one does not.

5
20 to 35 days

Final judgment, and a sale date

If the lender wins, the judgment sets a sale date not less than 20 and not more than 35 days after the judgment, unless the plaintiff agrees to later. The notice of sale is then published.

6
often does not happen

The auction

Conducted online through the clerk. A great many scheduled sales across Florida are cancelled rather than held, for reinstatement, modification, a sale that closed first, bankruptcy or a procedural defect. A sale date is a deadline, not a verdict.

7
10 days

Certificate of sale, then title

The clerk files the certificate of sale promptly after the sale. Objections may be filed within 10 days, and if none are filed the clerk issues the certificate of title. That is the moment ownership genuinely changes, not the auction itself.

I have written about the twenty day window in detail in you have 20 days, here is what to file, and about how often sales get cancelled in why two thirds of Duval County foreclosure auctions never happen. The cancellation pattern is a Florida pattern, not a Duval one, and it applies to Clay sales too.

03What Is Really Driving Defaults Here

This is where a Clay County page should differ from a generic one, because the reason people fall behind here is specific.

It is almost never job loss. The overwhelming majority of people who ring me from Clay County are current on everything in their life except a mortgage payment that grew by several hundred dollars without their income moving at all.

Insurance. A carrier non renews, often over roof age, and either the replacement premium is brutal or the policy lapses and the servicer force places coverage at two to three times the market rate. The premium goes through escrow, which creates a shortage, which is then spread over twelve months on top of the higher premium going forward. That is how a payment jumps eight hundred dollars with nothing about the loan changing. The whole chain, including the roof statute at section 627.7011 and the federal notice rules the servicer owes you, is in your insurance got cancelled and your mortgage payment jumped.

Property taxes. The other half of escrow. And for anybody without a mortgage, the quiet route to losing a paid off house entirely, because unpaid taxes become a certificate and eventually a tax deed. The full timeline is in cannot pay your Florida property taxes.

Military and veteran households. Orange Park sits next to NAS Jax, and there are a great many VA loans in this county. If that is you, the information you have is probably out of date, because the VA brought back a partial claim in June 2026 after VASP closed in May 2025. It clears your arrears without touching your interest rate, which matters enormously if you have a pandemic era rate. See behind on a VA loan in Florida.

And the one that is specific to several Clay communities. Which gets its own section.

04The CDD Line On Your Tax Bill

If you bought in one of the newer master planned communities in this county, go and pull up your November tax bill and look for a line that says CDD or Community Development District.

A CDD is a district established under Chapter 190 of the Florida Statutes. It is not your HOA and it is not a voluntary fee. It is collected by the county tax collector as a non ad valorem assessment on the annual property tax bill, and it comes in two parts: a bond or debt portion that typically runs 20 to 30 years, and an operations and maintenance portion that continues for as long as the district exists.

$1,000 to $3,000
a year is a common range for a Florida CDD assessment, on top of your property taxes, your HOA and your insurance.
Because it rides on the property tax bill as a non ad valorem assessment, it carries the same enforcement. Unpaid, it becomes part of a delinquency that can end in a tax certificate. The bond portion can usually be prepaid, and the district office will give you a payoff quote.
Chapter 190, Florida Statutes

Why this matters for a page about foreclosure: it is a four figure annual obligation that many owners did not fully understand when they bought, it sits in the escrow calculation alongside taxes and insurance, and it does not go away because money is tight.

Three practical things. Find out whether you are in a district at all, which your tax bill will tell you. Find out what the bond portion is and roughly when it ends, which the district office will tell you. And if you ever come into money, ask for a payoff quote on the bond portion, because prepaying it removes that line from every future tax bill, which is a permanent reduction in your housing cost rather than a one off.

05Who To Ring In Clay County

Free, and genuinely good

A HUD approved housing counselor

On 800-569-4287. Free, and they deal with servicers daily. Applications fail on missing paperwork far more often than on income, and this is the help that fixes exactly that. Ring them before you ring anybody who wants to buy your house, me included.

Serves Clay County

Jacksonville Area Legal Aid

Serves qualifying households across the Fourth Circuit region, Clay included. If money is why you have no attorney, start here rather than assuming you cannot have one. Many private foreclosure defence attorneys also offer a free first consultation.

The tax side

Clay County Tax Collector

Ring with your parcel number and ask which years are unpaid, whether any certificates exist, and whether a tax deed application has been filed. Ask about the four payment installment plan, which has a 30 April application deadline for the following year and which almost nobody uses.

Older homeowners

Elder Helpline and ElderSource

The Florida Elder Helpline is 800-963-5337. ElderSource is the Area Agency on Aging covering Clay among other Northeast Florida counties, on 904-391-6600. For a fixed income household there is more available than most families realise.

free, and local

And one more that is free and that people skip: your own servicer’s loss mitigation department. Not the general line, loss mitigation specifically. Ask what you qualify for, ask what documents they need, and ask for a written reinstatement quote and a written payoff figure. Those two numbers plus a realistic value on your house will tell you in about five minutes which road you are actually on.

06Clay County, Town By Town

The county is not one market and the situations are not the same from one end of it to the other.

Orange Park. Older housing stock, established neighbourhoods, and a large military and veteran population because of the proximity to NAS Jax. A lot of VA loans, a lot of long term owners with substantial equity they have not thought about, and a lot of thirty year old roofs that carriers have started declining. The VA partial claim is particularly relevant here.

Fleming Island. Newer, higher values, master planned, and where CDD assessments turn up on tax bills. Households here are more often hit by the combination of a high escrow and a high HOA rather than by a small bill they cannot meet.

Middleburg. More land, more acreage parcels, more septic and well rather than utilities. Insurance and roof questions bite differently out here, and a house on five acres is a different sale from a house on a quarter acre. I have listed in The Ravines and the market out there behaves on its own terms.

Green Cove Springs. The county seat, so the courthouse is here, alongside a lot of older homes and a lot of recent growth driven by the First Coast Expressway opening the area up. A mix of long term owners and very new buyers, with very different problems.

Oakleaf and the Argyle corridor. Heavily built out in the 2000s and again recently. CDD country. Also the area where you see people who bought at the very edge of affordability and then watched Florida insurance and taxes move against them.

Keystone Heights and the south of the county. Rural, lake country, further from everything, and a market with far fewer comparable sales. Valuations are harder, financed buyers are thinner on the ground, and a cash sale often matters more here than it does closer to the river.

07Your Five Options

These are the same everywhere in Florida. What changes county to county is which ones are realistic for you.

Reinstate. Pay the arrears plus fees and costs and the case ends, with your mortgage carrying on as before. Expensive, and more achievable than people assume once family, a credit union or an equity line is in the picture.

Modify. The single most common genuine rescue, and most people who do not get one never applied. Who owns or insures your loan decides which programmes exist for you, which is why finding that out comes first. See can I get a loan modification in Florida.

Sell with equity. If the house is worth more than the debt, selling before judgment keeps the difference in your pocket rather than handing it to the process. Clay values have moved a great deal since 2020 and plenty of people in default here have equity they have not thought about, because they have been staring at the payment rather than the value.

Short sale or deed in lieu. Where the house is worth less than the debt. Both land softer than a completed foreclosure. There is an important wrinkle in how each affects a later deficiency claim, which I have set out in they took the house, can they still come after me for the rest.

Sell as is, for cash. No repairs, no showings, no financing contingency, no insurance step to fail, and you pick the closing date. What I do, and the right answer when the clock has run down or the house will not survive a buyer’s inspection and carrier review.

08Selling In Clay County Specifically

Two practical things about selling here that are worth knowing before you decide.

Closing costs. In this part of Florida the seller customarily pays the owner’s title insurance policy, which also means the seller customarily chooses the closing agent. Documentary stamp tax on the deed runs at $0.70 per $100 of the sale price and is customarily a seller cost. All in, seller costs commonly land around 6 to 10 percent of the price with commission included and roughly 1 to 3 percent without it. Work out your net before you decide anything, not after.

Who the buyer is. On an older Orange Park house with an aged roof, or anything rural in the south of the county, a financed buyer has to get a carrier to agree to write the policy before their lender will close. That insurance step kills more Florida deals than people realise, and it is the reason a cash offer on a house with condition issues is worth more than the headline number suggests. I have written that up in 1 in 7 deals die after the inspection.

And the honest part. If a few thousand dollars of targeted repairs would get you a traditional listing at a meaningfully better number, do that and do not call me. If a modification fixes your payment, take the modification. I say I save more homes than I sell and I mean it literally, and in a county this size that reputation is the only asset worth having.

What people believe

My case is in Jacksonville because that is the nearest city.

What is true

Clay County cases are filed at the Clay County Courthouse in Green Cove Springs, in the Fourth Judicial Circuit.

What people believe

I fell behind because I am bad with money.

What is true

Most Clay defaults I see start with an insurance non renewal and an escrow recalculation. The loan never changed. The escrow did.

What people believe

There is a sale date, so it is finished.

What is true

A large share of scheduled Florida auctions are cancelled rather than held. Nearly every one of those happens because somebody acted.

KA

The gentleman in Orange Park did not sell.

We got a real policy bound in under two weeks, sent the declarations page certified, and asked for a fresh escrow analysis using the actual premium instead of the force placed one. Then he rang his servicer, said the words VA partial claim, and got told yes by the second person he spoke to.

He is still in that house. I made nothing.

That is most of what this job actually is, and it is why I would rather write the page that keeps you out of my inbox than the one that gets me ten phone calls from people who waited too long.

If you inherited a house in Clay County

This comes up constantly out here, particularly in Green Cove Springs and the older Orange Park neighbourhoods where a lot of houses are paid off and have been in the same family for decades. Three things. The tax bill keeps arriving in the deceased person’s name at an address nobody is checking, so ring the Clay County Tax Collector with the parcel number today and ask what is owed. The homestead exemption and the Save Our Homes cap do not survive the owner, which is why inherited tax bills are often far bigger than the family expects. And the probate route may be cheaper than you have been told, because Florida’s summary administration ceiling doubled to $150,000 on 1 July 2026 and protected homestead is generally excluded from that calculation. I have written it up in Florida’s small estate limit just doubled.

Five things, if that is all you keep.
Your case is in Green Cove Springs. Read your own docket on clayclerk.com. Respond within 20 days of service. Fix the escrow, not just the arrears. Ring the free help before you ring a buyer.

Questions People Ask Me

Where are Clay County foreclosure cases filed?

At the Clay County Courthouse, 825 North Orange Avenue, Green Cove Springs, Florida 32043. Clay sits in Florida’s Fourth Judicial Circuit along with Duval and Nassau counties. You can look your own case up free through the Clay County Clerk of Courts at clayclerk.com, searching by party name, case number or attorney, and read the docket, the filings, hearing schedules and case status yourself.

How do Clay County foreclosure auctions work?

Sales are conducted online through the clerk and are scheduled and publicly advertised after a final judgment is entered. Bidders register and place deposits in advance. Under Florida Statutes section 45.031 the judgment sets a sale date not less than 20 and not more than 35 days after the judgment unless the plaintiff agrees to a later date, and the notice of sale is published before the sale.

How long does foreclosure take in Clay County?

It varies enormously, mainly on whether you respond and whether you have an attorney. Florida is a judicial foreclosure state so the lender has to sue and win, which takes months at minimum. An undefended case moves quickly toward judgment. A defended one does not. After judgment the sale is set 20 to 35 days out, and after the sale the clerk files a certificate of sale, objections may be filed within 10 days, and then the certificate of title issues.

How long do I have to respond after being served in Clay County?

Generally 20 days from the date you are formally served with the summons and complaint. This is the single most important deadline in the process. Missing it risks a default judgment, which removes most of your ability to raise defences or negotiate from any position of strength. If you have been served, speak with a Florida foreclosure attorney straight away, and check whether Jacksonville Area Legal Aid can assist if cost is the obstacle.

Why did my mortgage payment go up when my loan did not change?

Almost certainly escrow, and in Clay County that usually means insurance. A carrier non renews, often over roof age, and either the replacement premium is much higher or the policy lapses and your servicer force places coverage at two to three times the market rate. That premium is paid from escrow, creating a shortage, and the next escrow analysis collects both the higher premium going forward and the shortage spread over twelve months. Nothing about your mortgage moved. Only the escrow did.

What is the CDD line on my Clay County tax bill?

A Community Development District assessment, established under Chapter 190 of the Florida Statutes. It is not your HOA. It is collected by the county tax collector as a non ad valorem assessment on your annual property tax bill, in two parts: a bond or debt portion that typically runs 20 to 30 years, and an operations and maintenance portion that continues as long as the district exists. Commonly $1,000 to $3,000 a year. Because it rides on the tax bill it carries the same enforcement as property taxes.

Can I pay off the CDD bond early?

On many lots, yes. The bond or debt portion can usually be prepaid in a lump sum, which removes that line from every future tax bill. Request a payoff quote from the district office. The operations and maintenance portion continues regardless, since it funds the ongoing upkeep of the community. If you are ever in a position to do it, prepaying the bond is a permanent reduction in your annual housing cost rather than a one off saving.

I am a veteran in Orange Park. Are there options specific to me?

Yes, and your information may be out of date. The VA’s VASP programme closed to new applicants on 1 May 2025, which left a real gap for about a year. The VA Home Loan Program Reform Act then authorised a new partial claim, and servicers could begin submitting trial payment plans from 15 June 2026. It clears your arrears without touching your first mortgage, so your interest rate, term and payment all stay exactly as they are. Ring your servicer, ask for loss mitigation, and use the phrase “VA partial claim”. The VA itself is on 877-827-3702.

Where can I get free foreclosure help in Clay County?

A HUD approved housing counselor on 800-569-4287, which is free and genuinely useful because applications fail on paperwork far more often than on income. Jacksonville Area Legal Aid serves qualifying households across the region including Clay. Many private foreclosure defence attorneys offer a free first consultation. And for older homeowners, the Florida Elder Helpline is 800-963-5337 and ElderSource, the Area Agency on Aging covering this part of Northeast Florida, is on 904-391-6600.

Can I sell my house in Clay County while it is in foreclosure?

Yes, right up until title changes, and it is frequently the best outcome available. A closing that pays the judgment cancels the sale, and if there is equity you keep the difference rather than handing it to the process. Clay values have risen considerably since 2020 and a great many people in default here have substantial equity without realising it, because they have been looking at the payment rather than the value.

What are seller closing costs in Clay County?

In this part of Florida the seller customarily pays the owner’s title insurance policy, which also means the seller customarily selects the closing agent. Documentary stamp tax on the deed is $0.70 per $100 of the sale price and is customarily a seller cost. Overall, seller costs commonly run about 6 to 10 percent of the price with real estate commission included, and roughly 1 to 3 percent without it. Get a net sheet before you make any decision.

Is a cash sale worth it in Middleburg or Keystone Heights?

Often more than it is closer to the river, for two reasons. Rural and acreage properties have fewer comparable sales, which makes appraisals harder and financed deals riskier. And on older properties a buyer’s lender will not close until a carrier agrees to write a policy, which is an extra step that kills Florida deals regularly. A cash buyer is not asking a carrier for permission and is not dependent on an appraisal coming in. That certainty is worth something real, and it is why the headline number on a cash offer understates the comparison.

My house is paid off. Can I still lose it?

Yes, through unpaid property taxes, and it is the quietest way it happens. Taxes become delinquent on 1 April, a tax certificate on the debt is sold at auction on or before 1 June, and under section 197.502 the certificate holder may apply for a tax deed once two years have elapsed since 1 April of the year the certificate was issued. Ring the Clay County Tax Collector with your parcel number and ask which years are unpaid and whether any application has been filed.

Does a sale date mean it is over?

No. A large share of scheduled Florida foreclosure auctions are cancelled rather than held, for reinstatement, an approved modification, a sale that closed first, a bankruptcy filing or a procedural defect in the case. Nearly all of those happen because somebody acted, usually in the last few weeks. Having a date on the calendar is a deadline, not a verdict, and it is a reason to move rather than a reason to stop.

Do you actually work Clay County or just Jacksonville?

Clay properly. I have listed in The Ravines in Middleburg, worked with families in Orange Park, and I am across Blanding, 17 and the 220 corridor most weeks. I will come to you, I will look at the house, and I will tell you honestly whether what you need is a cash offer, a traditional listing, a modification, or a phone call to a counselor that costs you nothing. If it is one of the last three, I will say so and point you at it.

A gentle note: I am a Florida Realtor with Momentum Realty and a home buyer, not an attorney, and this is general information rather than advice about your case or your property.
